Should he turn to the human rights organizations to get his rights?

What is the ruling on turning to international human rights organizations if a Muslim hopes that his rights will be restored to him? What is the ruling on turning to the human rights organization in Saudi Arabia?.
Praise be to Allaah.

Firstly:

We have previously explained in the answer to question no. 97827 some of what is hidden behind the attractive principles of these international organizations which have evil aims that go against the laws of Allaah. In the light of that, it is not permissible for the Muslims to get involved with these organizations by establishing them, helping them or supporting them, and it is not permissible for a Muslim to be a member of such an organization.

Based on this, it is not permissible for the Muslim who can find a shar’i way to restore his rights to refer the matter to these organizations, because they are based on principles that are opposed to religion and morals. Referring to them for judgement when there are ways to refer to Islamic resources constitutes kufr or disbelief in Allaah, may He be exalted. It may be kufr that puts one beyond the pale of Islam or it may be a lesser form of kufr, depending on the individual’s beliefs and circumstances, as we shall see below.

Shaykh Muhammad ibn Ibraaheem (may Allaah have mercy on him) said:

One of the worst of evil deeds is referring for judgement to something other than the sharee’ah of Allaah, namely man-made laws and human-made systems, the customs of one’s ancestors and forefathers, and the verdicts of soothsayers, magicians and astrologers, which many people do nowadays and approve of instead of the sharee’ah of Allaah with which He sent His Messenger Muhammad (peace and blessings of Allaah be upon him). Undoubtedly this is the worst type of hypocrisy and among the greatest signs of kufr, wrongdoing and evil, and it is the rulings of the Jaahiliyyah, which the Qur’aan annulled and which the Messenger of Allaah (peace and blessings of Allaah be upon him) warned against.

Allaah says (interpretation of the meaning):

“Have you not seen those (hypocrites) who claim that they believe in that which has been sent down to you, and that which was sent down before you, and they wish to go for judgement (in their disputes) to the Taaghoot (false judges) while they have been ordered to reject them. But Shaytaan (Satan) wishes to lead them far astray.

61. And when it is said to them: ‘Come to what Allaah has sent down and to the Messenger (Muhammad صلى الله عليه وسلم),’ you (Muhammad صلى الله عليه وسلم) see the hypocrites turn away from you (Muhammad صلى الله عليه وسلم) with aversion”

[al-Nisa’ 4:60, 61]

“ And so judge (you O Muhammad صلى الله عليه وسلم) among them by what Allaah has revealed and follow not their vain desires, but beware of them lest they turn you (O Muhammad صلى الله عليه وسلم) far away from some of that which Allaah has sent down to you. And if they turn away, then know that Allaah’s Will is to punish them for some sins of theirs. And truly, most of men are Faasiqoon (rebellious and disobedient to Allaah).

50. Do they then seek the judgement of (the days of) Ignorance? And who is better in judgement than Allaah for a people who have firm Faith”

[al-Maa’idah 5:49, 50]

“And whosoever does not judge by what Allaah has revealed, such are the Kaafiroon (i.e. disbelievers — of a lesser degree as they do not act on Allaah’s Laws)”

[al-Maa’idah 5:44]

“And whosoever does not judge by that which Allaah has revealed, such are the Zaalimoon (polytheists and wrongdoers — of a lesser degree)”

[al-Maa’idah 5:45]

“And whosoever does not judge by what Allaah has revealed (then) such (people) are the Faasiqoon [the rebellious i.e. disobedient (of a lesser degree)] to Allaah”

[al-Maa'idah 5:47]

This is a stern warning from Allaah to all people against turning away from His Book and the Sunnah of His Messenger (peace and blessings of Allaah be upon him), and referring for judgement to anything else. It is a clear ruling from the Lord against judging by anything other than His sharee’ah, that such a one is a kaafir, a wrongdoer and a rebellious evildoer, whose attitude is that of the hypocrites and people of Jaahiliyyah. So beware, O Muslims, of that which Allaah has warned against, and refer to His laws for judgement in all things. Beware of that which goes against them, and advise one another concerning that. Regard as a enemy the one who turns away from the sharee’ah of Allaah or belittles it or makes fun of it, and who facilitates turning to anything else for judgement, so that you may earn the honour of Allaah and be safe from the punishment of Allaah, and thus you will have done what Allaah has enjoined upon you of taking His close friends as friends, who refer to His sharee’ah for judgement and who are pleased with His Book and the Sunnah of His Prophet (peace and blessings of Allaah be upon him), and taking as enemies His enemies who turn away from His Book and the Sunnah of His Prophet (peace and blessings of Allaah be upon him).

Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allaah have mercy on him) was asked:

What is your opinion about Muslims who refer for judgement to man-made laws, when the Qur’aan and Sunnah are among them?

He replied:

My opinion concerning this type of people who call themselves Muslims although they refer for judgement to something other than that which Allaah has revealed and think that the laws of Allaah are not sufficient and are not fit for ruling in this era, is that which Allaah said concerning them, as He says (interpretation of the meaning):

“But no, by your Lord, they can have no Faith, until they make you (O Muhammad صلى الله عليه وسلم) judge in all disputes between them, and find in themselves no resistance against your decisions, and accept (them) with full submission”

[al-Nisa’ 4:65]

“And whosoever does not judge by what Allaah has revealed, such are the Kaafiroon (i.e. disbelievers — of a lesser degree as they do not act on Allaah’s Laws)”

[al-Maa’idah 5:44]

“And whosoever does not judge by that which Allaah has revealed, such are the Zaalimoon (polytheists and wrongdoers — of a lesser degree)”

So those who refer for judgement to something other than the laws of Allaah, and think that this is permissible for them, or that it is better than referring for judgement to the laws of Allaah, undoubtedly go beyond the pale of Islam because of that, and they are kaafirs, wrongdoers and rebellious evildoers, as it says in the verses quoted above and elsewhere, and Allaah says (interpretation of the meaning):

“Do they then seek the judgement of (the days of) Ignorance? And who is better in judgement than Allaah for a people who have firm Faith”

If the Muslim cannot find any way to attain his rights by permissible means, and things are too difficult for him, then he can turn to these organizations and refer to them for judgement, if his case is legitimate and he cannot get his rights by permissible means. This is a case of necessity, and the basic shar’i principle is that cases of necessity make forbidden things permissible.

Fourthly:

With regard to the human rights organizations in Saudi Arabia, there are two organizations, as far as we know.

1 – al-Jama’iyyah al-Wataniyyah li Huqooq al-Insaan (National Human Rights Group)

2 – Hay’at Huqooq al-Insaan (Human Rights Organization)

There is nothing wrong with referring your case and your complaint to them, because they are organizations that are not based on the systems, laws and principles of the international human rights organizations, rather they differ from them in many ways, and those groups have criticized these two groups and the state with regard to many issues.

The aims of the National Human Rights Group – according to their website – include the following:

- Working to protect human rights according to the system of laws that is based on the Qur’aan and Sunnah, and according to local legislation, and the declarations and covenants on human rights proclaimed by the Arab League, the Organization of the Islamic Conference, the United Nations and its agencies and specialized committees, in that which does not go against Islamic sharee’ah.

- Cooperating with international organizations in this field.

- Taking a stand against oppression, repression, violence, torture and intolerance.

The words “in that which does not go against Islamic sharee’ah” are a source of pride, and clearly show that there is nothing wrong with referring to them for help with regard to the wrong that has been done to you.

Something similar may be said about the Human Rights Organization, whose founding statement says that it aims to protect and support human rights and spread awareness about them, and reinforce these principles, in the light of the rulings of Islamic sharee’ah. Stated by its president in an interview with him in al-Riyaadh newspaper, 8 Jumaada al-Oola 1427 AH/ 5 June 2006, issue no. 10051.

Intercourse with female prisoners of war


At the present time, is it Halal to have a sexual intercourse with your Loundi (a female prisoner of war) without getting married to her?.
Praise be to Allaah.

It is not permissible for a man to have intercourse with anyone except his wife or his female slave (concubine). A wife becomes permissible after shar’i marriage and a concubine becomes permissible to the man who owns her. She may originally be a prisoner of war, and a Muslim may obtain a concubine from the ruler or commander if he took part in fighting in jihad, or if he buys her from her owner. She becomes permissible for him by virtue of his ownership after it is established that she is not pregnant by waiting for one menstrual cycle, or until she has given birth if she is pregnant.

Allaah says (interpretation of the meaning):

“And those who guard their chastity (i.e. private parts, from illegal sexual acts)

6. Except from their wives or (the slaves) that their right hands possess, ـــ for then, they are free from blame”

[al-Mu’minoon 23:5-6]

It was narrated that Abu Sa’eed al-Khudri said: The Prophet (peace and blessings of Allaah be upon him) said, concerning the prisoners of Awtaas: “Do not have intercourse with a pregnant woman until she gives birth, or with one who is not pregnant until she has menstruated once.” Narrated by Abu Dawood, 2157. This hadeeth was classed as saheeh by Shaykh al-Albaani in Irwa’ al-Ghaleel, 187.

In the answer to question no. 10382 we have stated that Islam permits a man to have intercourse with his slave woman whether he has one or more wives or he is not married.

In the answers to questions no. 5707 and 12562 it states that female prisoners of war may be distributed by the commander in jihad, because he has the choice of either distributing them, or ransoming them or setting them free.

How can we understand the strength of Israel in the context the approach of the onset of the Hour?

The prophet(saw)said that the signs would come very quickly, also that he was the beginning of those signs...what is happening right now? how is it possible that israel is so powerfull on earth?.
Praise be to Allaah.

The portents of the Hour are not all of the same degree, rather some of them are minor and some are major. The major signs are those which, when the first one appears, the others will follow like beads falling from a broken string. But with regard to the minor signs, there is a long period of time between the first and the last of them. The sending of the Prophet (peace and blessings of Allaah be upon him) was one of the minor signs of the Hour, not one of the major portents.

It was narrated that Anas said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “I and the Hour have been sent like these two.” He said, And he held up his index and middle fingers together.

Narrated by al-Bukhaari, 6139; Muslim, 2951.

Al-Qurtubi said:

The first of the portents of the Hours is the Prophet (peace and blessings of Allaah be upon him), because he is the Prophet of the end of time. He has been sent and there will be no Prophet between him and the Resurrection.

With regard to the strength of Israel (the Jewish state), this is something that has happened to them by the will and decree of Allaah.

Allaah says (interpretation of the meaning):

“Indignity is put over them wherever they may be, except when under a covenant (of protection) from Allaah, and from men”

[Aal ‘Imraan 3:112]

Allaah has given them power and respite, but that is only so that when He does seize them, He will seize them severely.

It was narrated that Abu Moosa (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him) said: Allaah gives respite to the wrongdoer until, when He seizes him, He does not let him go.” Then he recited (interpretation of the meaning):

“Such is the Seizure of your Lord when He seizes the (population of) towns while they are doing wrong. Verily, His Seizure is painful (and) severe”

[Hood 11:102]

Narrated by al-Bukhaari, 4409; Muslim, 2583.

At the time of the Mahdi and when ‘Eesa (peace be upon him) comes down, the Muslims’ victory over the Jews will be complete.

It is proven (in the hadeeth) then when the leader of the Muslims, the Mahdi will come to lead them in praying Fajr, ‘Eesa ibn Maryam will come down to them, and the imam will step back so that ‘Eesa can come forward and lead the prayer, but ‘Eesa will put his hand on his back and say, “Go forward and lead the prayer, for the iqaamah was given for you.” So their imam will lead them in prayer, and when he has finished, then ‘Eesa will head towards the Dajjaal, with whom will be seventy thousand Jews. When the Dajjaal looks at him, he will melt like salt in water, and the Messiah ‘Eesa (peace be upon him) will catch up with him at the gate of Lod (which is a town near Jerusalem) and kill him. Then Allaah will cause the defeat the Jews, and there will be nothing that Allaah has created that a Jew hides behind, but Allaah will cause that thing to speak. Rocks, trees, walls and animals will all say, ‘O Muslim, O slave of Allaah, here is a Jew, come and kill him!’ – except for the box-thorn tree (al-gharqad), for it is one of their trees and will not speak.”

If the Muslims want to defeat the Jews and all kaafirs, they have to turn back to Allaah and support His religion until Allaah grants them victory, for the Jews are too insignificant for words, but they took advantage of the fact that the Muslims have turned away from their religion.

We ask Allaah to being the Muslims back to their religion and help them follow it properly.

Why is alcohol forbidden in Islam?

Intoxicants were forbidden in the Qur'an through several separate verses revealed at different times over a period of years. At first, it was forbidden for Muslims to attend to prayers while intoxicated (4:43). Then a later verse was revealed which said that alcohol contains some good and some evil, but the evil is greater than the good (2:219). This was the next step in turning people away from consumption of it. Finally, "intoxicants and games of chance" were called "abominations of Satan's handiwork," intended to turn people away from God and forget about prayer, and Muslims were ordered to abstain (5:90-91). (Note - the Qur'an is not arranged chronologically, so later verses of the book were not necessarily revealed after earlier verses.)
In the first verse cited above, the word for "intoxicated" is sukara which is derived from the word "sugar" and means drunk or intoxicated. That verse doesn't mention the drink which makes one so. In the next verses cited, the word which is often translated as "wine" or "intoxicants" is al-khamr, which is related to the verb "to ferment." This word could be used to describe other intoxicants such as beer, although wine is the most common understanding of the word.

Muslims interpret these verses in total to forbid any intoxicating substance -- whether it be wine, beer, gin, whiskey, or whatever. The result is the same, and the Qur'an outlines that it is the intoxication, which makes one forgetful of God and prayer, which is harmful. Over the years, the list of intoxicating substances has come to include more modern street drugs and the like.

The Prophet Muhammad also instructed his followers, at the time, to avoid any intoxicating substances -- (paraphrased) "if it intoxicates in a large amount, it is forbidden even in a small amount." For this reason, most observant Muslims avoid alcohol in any form, even small amounts that are sometimes used in cooking.

The forbidden price - Alcoholic Maldives

Assalaam Aleikum,Is it sinful to buy liqor or other Alcoholic drinks to non muslims? As for myself I have never even tested alcohol and would discourage other muslims from doing so
al-hamdu lillaah.

It is not permissible for a Muslim to sell wine (or any other intoxicating substance) to non-Muslims, because the Prophet (peace be upon him) said:

"Verily when Allaah forbids something, he forbids its price"

(i.e. forbids earning money from it). The Prophet also cursed ten types of people relating to the issue of wine, among them the one who sells it. In addition, selling it would be assisting and abetting people in sin and transgression, and Allaah the Almighty has said (interpretation of the meaning):

...and do not aid and abet one another in sin and transgression. (al-Maa'ida 5:2)

It is incumbent upon you to advise those who have fallen into this evil among the Muslims, that he should repent to Allah the Most Glorified and desist this practice.

virtues of the first ten days of Dhu’l-Hijjah

Are the first ten days of Dhu’l-Hijjah more special than other days? What are the righteous deeds that it is recommended to do a lot of during these ten days?.
Praise be to Allaah.

Among the great seasons of worship are the first ten days of Dhu’l-Hijjah, which Allaah has favoured over other days. It was narrated from Ibn ‘Abbaas (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “There are no days on which righteous deeds are more beloved to Allaah than these ten days.” They said: “Not even jihad for the sake of Allaah?” He said: “Not even jihad for the sake of Allaah, unless a man goes out himself for jihad taking his wealth with him and does not come back with anything.” Narrated by al-Bukhaari, 2/457

It was also narrated from Anas (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “There is no deed that is better before Allaah or more greatly rewarded than a good deed done in the (first) ten days of al-Adha.” It was said: “Not even jihad for the sake of Allaah?” He said: “Not even jihad for the sake of Allaah, unless a man goes out himself for jihad taking his wealth with him and does not come back with anything.” Narrated by al-Daarimi, 1/357; its isnaad is hasan as stated in al-Irwa’, 3/398.

These texts and others indicate that these ten days are better than all other days of the year, with no exception, even the last ten days of Ramadaan. But the last ten nights of Ramadaan are better than the first ten nights of Dhu’l-Hijjah, because they include Laylat al-Qadr, which is better than a thousand months. See Tafseer Ibn Katheer, 5/412.

So the Muslim should start these days with sincere repentance to Allaah, then he should do a lot of righteous deeds in general, then he should pay attention to doing the following deeds:

1 – Fasting

It is Sunnah for the Muslim to fast on the first nine days of Dhu’l-Hijjah, because the Prophet (peace and blessings of Allaah be upon him) encouraged us to do righteous deeds in the first ten days of Dhu’l-Hijjah, and fasting is one of the best of deeds, which Allaah has chosen for Himself as it says in the hadeeth qudsi: “Allaah says: ‘All the deeds of the son of Adam are for him, except fasting, which is for Me and I shall reward for it.” Narrated by al-Bukhaari, 1805.

The Prophet (peace and blessings of Allaah be upon him) used to fast on the first nine days of Dhu’l-Hijjah. It was narrated from Hunaydah ibn Khaalid from his wife, that one of the wives of the Prophet (peace and blessings of Allaah be upon him) said: The Prophet (peace and blessings of Allaah be upon him) used to fast on the first nine days of Dhu’l-Hijjah and the day of ‘Ashoora’, and three days each month, the first Monday of the month and two Thursdays. Narrated by al-Nasaa’i, 4/205 and by Abu Dawood; classed as saheeh by al-Albaani in Saheeh Abi Dawood, 2/462.

2 – Reciting tahmeed, tahleel and takbeer a great deal

It is Sunnah to recite takbeer (saying Allaahu akbar (Allaah is most great)), tahmeed (saying al-hamdu Lillah (praise be to Allaah)), tahleel (saying Laa ilaaha ill-Allaah (There is no god but Allaah)) and tasbeeh (saying Subhaan-Allaah (Glory be to Allaah)), during the first ten days of Dhu’l-Hijjah, saying these words out loud in the mosques, homes, streets and every place in which it is permissible to remember Allaah, to perform this act of worship openly and proclaim the greatness of Allaah.

Men should recite out loud and women should recite quietly.

Allaah says (interpretation of the meaning):

“That they may witness things that are of benefit to them (i.e. reward of Hajj in the Hereafter, and also some worldly gain from trade), and mention the Name of Allaah on appointed days, over the beast of cattle that He has provided for them (for sacrifice)”

[al-Hajj 22:28]

The majority are of the view that the “appointed days” are the first ten days of Dhu’l-Hijjah, because it was narrated from Ibn ‘Abbaas (may Allaah be pleased with him) that the appointed days are the first ten days of Dhu’l-Hijjah.

It was narrated from ‘Abd-Allaah ibn ‘Umar (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “There are no days that are greater before Allaah or in which good deeds are more beloved to Him, than these ten days, so recite a great deal of tahleel, takbeer and tahmeed during them.” Narrated by Ahmad, 7/224; its isnaad was classed as saheeh by Ahmad Shaakir.

The takbeer is as follows:

Allaah akbar, Allaahu akbar, laa ilaaha ill-Allaah, Allaahu akbar, wa Lillaah il-hamd (Allaah is Most Great, Allaah is Most Great, there is no god but Allaah; Allaah is Most Great and to Allaah be praise).

And there are other versions.

This takbeer has become a forsaken Sunnah nowadays, especially at the beginning of these ten days. You can hardly hear it except from a few. It should be recited out loud, so as to revive the Sunnah and remind the heedless. It was proven that Ibn ‘Umar and Abu Hurayrah (may Allaah be pleased with them both) used to go out to the marketplace during the first ten days of Dhu’l-Hijjah, reciting the takbeer our loud, and the people would recite takbeer when they heard them, i.e., the people would remember the talkbeer and each one would recite it by himself; it does not mean that they recited in unison – that is not prescribed in sharee’ah.

Reviving Sunnahs that have been forgotten brings a great deal of reward, as is indicated by the words of the Prophet (peace and blessings of Allaah be upon him): “Whoever revives one of my Sunnahs that has died out after I am gone, will have a reward like that of everyone who does it, without that detracting from their reward in the slightest.” Narrated by al-Tirmidhi, 7/443; this hadeeth is hasan because of corroborating reports.

3 – Doing Hajj and ‘Umrah

One of the greatest deeds that can be done during these ten days is Hajj to the sacred House of Allaah. Whoever Allaah helps to go on Hajj to His House and do the rituals in the required manner will – in sha Allaah – be included in the words of the Messenger of Allaah (peace and blessings of Allaah be upon him): “An accepted Hajj brings no less a reward than Paradise.”

4 – Udhiyah (sacrifice)

One of the righteous deeds that bring a person closer to Allaah in these ten days is to slaughter the sacrifice and to look for a good, fat animal and to spend money on it for the sake of Allaah.

Let us hasten to make the most of these great days, before the negligent regrets what he did, and before he asks to go back and receives no response.

Why has Islam continued to be so successful in the modern world?

Praise be to Allaah.

Islam continues to be successful in the developed world, and elsewhere, because its call is in accordance with the fitrah or natural inclinations of mankind, and it advocates the best of human values, such as tolerance, love, mercy, truthfulness and sincerity.

Islam educates people and lifts them up to righteous conduct, good manners and virtue. Its call is distinguished from others by its realism, balance and moderation. Islam pays due attention to both the soul and the body. It neither suppresses physical desires nor allows extravagance in this regard; it makes a distinction between the natural inclination to enjoy the pleasures of this world and forbidden desires that come under the heading of depravity and perversion.

People embrace Islam because they find security, comfort and peace in it, they see a cure for their problems in it, and through it they are able to get rid of their feelings of confusion, anxiety and loss.

Islam is the religion of the fitrah, the natural inclination or pattern on which Allaah has created mankind. For this reason, people of sound minds and upright inclinations embrace Islam, as Abu Hurayrah (may Allaah be pleased with him) said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) said: ‘There is no child who is not born in a state of fitrah (i.e., Islam), then his parents make him into a Jew, a Christian or a Magian (Zoroastrian), just as animals produce whole animals (i.e., the animals are born perfect with no part of their bodies missing). Do you find any born with their ears cut off?’” Then Abu Hurayrah (may Allaah be pleased with him) said: “ ‘… Allaah’s handiwork according to the pattern on which He has made mankind: no change (let there be) in the work (wrought) by Allaah: that is the Standard Religion…’ [al-Room 30:30 – interpretation of the meaning – Yusuf Ali’s translation].” (Reported by al-Bukhaari, 1359). What is meant is that Allaah has created mankind with the potential to learn the truth, accept Tawheed (pure monotheism) and submit to Allaah. Their natural inclination is to learn Islam and love it, but a bad education, a kaafir (disbelieving) environment, their own whims and desires and the devils among jinn and mankind turn them away from the truth. Mankind is basically inclined towards Tawheed (pure monotheism), as the Prophet (peace and blessings of Allaah be upon him) reported that his Lord (Allaah) said: “I created all my slaves as ‘hunafa’ (pure monetheists), but the devils turned them away from their religion.” (Reported by Muslim). For this reason the one who becomes a Muslim after having been a disbeliever is described as having “reverted” to Islam, as this is more correct than saying that he “converted.” When Islam enters a country where there is no nationalism or great legacy of jaahiliyah (ignorance), it spreads quickly because of its strength and the small number of obstacles. You may also see that Islam is suitable for all people, educated and uneducated, male and female, old and young; everyone finds in it what he wants and needs. Those who become Muslim in developed countries realize what their country’s civilization and laws, which have been fabricated from men’s whims and desires, have done to them, and they realize the extent of the misery in which people in developed countries are living. They see how prevalent psychological illnesses, nervous breakdowns, insanity and suicides are, despite the technological advances and great number of discoveries and inventions and modern systems of management. This is because all of that is concerned only with the physical and the outward, but it neglects the inward and fails to nourish and nurture the heart and soul. Allaah says of these people (interpretation of the meaning): “They know only the outside appearance of the life of the world, and they are heedless of the Hereafter.” [al-Room 30:7]

Islam will continue to succeed, with the permission of Allaah, so long as those who work for its sake are sincere and its followers adhere to it and believe in it, and apply its laws.

The fact that there are those who are not committed or who fall short will not prevent Islam from succeeding, with the permission of Allaah, and nothing can distort its beauty. Its light will not falter because some people abandon it or fail to adhere to it. What Islam has given humanity in the way of progress and civilization, and lifting them up from the darkness of oppression and enmity, is pride enough.

The problem is that i am homosexual

I am muslim 16 year old boy.i pray and fast regularly,i am straight but the problem is that i am homosexual, i first was thinking of my father , i think i became homosexual genetically, i see usually bad pictures, but i want to give up, i never done any sex in my life, i really am afraid of god, and i always pray for him to help me.
please sir, i beg you, tell me how practically can i get rid of this nasty desire

Praise be to Allaah.

we ask Allaah to heal you quickly from this serious disease, and to cleanse your heart of all evil, for He is Able to do that. For the harm caused by falling into this great sin is not limited to punishment in the Hereafter, rather it goes beyond that and a part of the punishment may happen in this world; even if it is nothing more than the regret and feelings of guilt that result from it, that is enough, so how about if that is accompanied by incurable fatal diseases which the doctors are agreed are widespread among homosexuals and are caused by these perverted practices? You may find more information on that if you refer to question no. 10050.

The way to deal with your problem is as follows:

Firstly:

You have to repent sincerely from your heart, turn to Allaah, regret what you have done, and pray a great deal to Allaah, asking Him to forgive you and help you to get rid of this problem. For Allaah is most Generous and is Close and always Responsive. Allaah says (interpretation of the meaning):

“Say: ‘O ‘Ibaadi (My slaves) who have transgressed against themselves (by committing evil deeds and sins)! Despair not of the Mercy of Allaah, verily, Allaah forgives all sins. Truly, He is Oft-Forgiving, Most Merciful’”

[al-Zumar 39:53]

So stand before Allaah weeping, beseeching, expressing your need for Him and seeking His forgiveness, and receive the glad tidings from Allaah of a way out and forgiveness.

Secondly:

Strive to plant the seeds of faith in your heart, for when they grow they will bear fruits of happiness in this world and in the Hereafter.

Faith in Allaah is what – after the help of Allaah – protects a person from falling into haraam things. The Prophet (peace and blessings of Allaah be upon him) said: “No adulterer is a believer at the moment when he is committing adultery.” (Narrated by al-Bukhaari, 2475; Muslim, 57). So when faith is well established in your heart and fills your heart and emotions, you will not violate His sacred limits, in sha Allaah. If the believer stumbles on one occasion he will quickly wake up. Allaah describes His slaves as follows (interpretation of the meaning):

“Verily, those who are Al-Muttaqoon (the pious), when an evil thought comes to them from Shaytaan (Satan), they remember (Allaah), and (indeed) they then see (aright)”

[al-A’raaf 7:201]

Thirdly:

Try to follow the advice which the Prophet (peace and blessings of Allaah be upon him) gave to young people, which is to get married if you are able to. Do not pay any attention to the fact that you are young, for being young is not a reason not to get married, far from it, so long as you have the need to get married. The Prophet (peace and blessings of Allaah be upon him) said: “O young men, whoever among you can afford to get married, let him do so, for it is more effective in lowering the gaze and protecting chastity. Whoever cannot afford that should fast, for it will be a shield for him.” (Narrated by al-Bukhaari, 5065; Muslim, 1400). Strive to follow this advice from the Prophet (peace and blessings of Allaah be upon him), for this is the solution to your problem, in sha Allaah.

There is nothing wrong with telling your father and mother of your need and desire to get married; don’t let shyness stop you from doing that.

Think seriously about marriage and do not fear poverty, and Allaah will grant you independence of means by His bounty. Allaah says (interpretation of the meaning):

“And marry those among you who are single (i.e. a man who has no wife and the woman who has no husband) and (also marry) the Saalihoon (pious, fit and capable ones) of your (male) slaves and maid-servants (female slaves). If they be poor, Allaah will enrich them out of His Bounty. And Allaah is All-Sufficient for His creatures’ needs, All-Knowing (about the state of the people)”

[al-Noor 24:32]

The Prophet (peace and blessings of Allaah be upon him) has told us that the one who gets married with a good intention, Allaah will help him. It was narrated from Abu Hurayrah (may Allaah be pleased with him) that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “There are three who are entitled to Allaah’s help: the mujaahid who fights for the sake of Allaah, the slave who made a contract of manumission with his master, wanting to buy his freedom, and the one who gets married, seeking chastity.” (Narrated by al-Tirmidhi, 1655; al-Nasaa’i, 3120; Ibn Maajah, 2518; classed as hasan by al-Albaani in Saheeh al-Targheeb wa’l-Tarheeb, 1917).

Fourthly:

If it is not easy for you to get married, then there is another solution, which is fasting. So why not think of fasting three days of each month, or on Mondays and Thursdays?

How great is the reward of fasting. The Prophet (peace and blessings of Allaah be upon him) said that Allaah said, “All the deeds of the son of Adam are for him except for fasting, which is for Me and I shall give reward for it.” (Narrated by al-Bukhaari, 1904; Muslim 1151).

And Allaah tells us that He has enjoined fasting on us so that we might become pious:

“O you who believe! Observing As-Sawm (the fasting) is prescribed for you as it was prescribed for those before you, that you may become Al-Muttaqoon (the pious)”

[al-Baqarah 2:183]

Fasting – as well as offering protection from following whims and desires and bringing a great reward from Allaah – also trains a person to have strong will, patience and forbearance, to rise above the desires and pleasures of the self. So hasten to fast so that Allaah may make things easier for you.

Fifthly:

Beware of thinking little of looking at haraam things in cheap magazines and nude pictures which lead to committing immoral actions that doom a person to Hell, and have deep and bad effects on the heart – Allaah forbid. Allaah says (interpretation of the meaning):

“Tell the believing men to lower their gaze (from looking at forbidden things), and protect their private parts (from illegal sexual acts). That is purer for them. Verily, Allaah is All-Aware of what they do”

[al-Noor 24:30]

You should note that if you think little of this evil, this gives the Shaytaan an opportunity to make other actions that lie beyond that seem attractive to you, which is obvious. But he will do that because you gave in to him, even if that only happened once.

Sixthly:

Remember, when the idea of sin come to you, or the Shaytaan whispers to you to commit a sin, that the parts of your body will bear witness against you on the Day of Resurrection for this sin. Do you not know that these limbs and this youthful energy are a blessing from Allaah to you? So can it be an act of gratitude to Allaah that you use them to disobey Allaah and rebel against the commands of Allaah?

There is another matter which you should pay attention to. Read with me the following verse (interpretation of the meaning):

“Till, when they reach it (Hell-fire), their hearing (ears) and their eyes and their skins will testify against them as to what they used to do.

And they will say to their skins, ‘Why do you testify against us?’ They will say: ‘Allaah has caused us to speak.’ He causes all things to speak, and He created you the first time, and to Him you are made to return”
[Fussilat 41:20-21]

It was narrated that Anas ibn Maalik said: “We were with the Messenger of Allaah (peace and blessings of Allaah be upon him) and he smiled and said, ‘Do you know why I am smiling?’ We said, ‘Allaah and His Messenger know best.’ He said, ‘Because of how a person will address his Lord. He will say, ‘O Lord, did You not guarantee me protection against injustice?’ He will say, ‘Yes.’ He will say, ‘I do not deem valid any witness against me but my own self.’ Allaah will say, ‘Your own self will be sufficient as a witness against you this Day, and the honourable scribes (recording angels) will also bear witness.’ Then a seal will be placed over his mouth and it will be said to his limbs, ‘Speak!’ And they will speak of his deeds. Then he will be allowed to speak and will say, ‘Away with you! It was for your sake that I argued.’” (Narrated by Muslim, 2969).

Seventhly:

Avoid being alone, for this makes you think about your desires. Try to fill your time with things that will benefit you, such as doing righteous deeds, reading Qur’aan, dhikr and prayer.

Eighthly:

Avoid keeping company with evil and immoral people who discuss these subjects, talk about things that provoke desire, take the matter of sin lightly and encourage it. You have to look for good friends who will remind you of Allaah and help you to obey Him. The Prophet (peace and blessings of Allaah be upon him) said, “A man will follow the religion of his close friend, so be careful about who you make friends with.” (Narrated by al-Tirmidhi, 2378; classed as hasan by al-Albaani in Saheeh al-Tirmidhi, 1937).

Ninthly:

If it so happens that you fall into sin in a moment of weakness, do not persist in that, rather be quick to repent to Allaah, lest you become one of those of whom Allaah says (interpretation of the meaning):

“And those who, when they have committed Faahishah (illegal sexual intercourse) or wronged themselves with evil, remember Allaah and ask forgiveness for their sins; — and none can forgive sins but Allaah — and do not persist in what (wrong) they have done, while they know”

[Aal ‘Imraan 3:135]

My brother, do not despair of the mercy of Allaah. Beware of letting the Shaytaan have any power over you or letting him whisper to you that Allaah will never forgive you. For Allaah forgives all sins of those who repent to Him.

20 Exam Tips for Students


Praise be to Allaah and peace and blessings be upon the Messenger and upon his family and companions.

The Muslim student puts his trust in Allaah when facing the tests of this world, and he seeks His help whilst following the prescribed means, in accordance with the words of the Prophet (peace and blessings of Allaah be upon him): “The strong believer is better and is more beloved to Allaah than the weak believer, although both are good. Strive to attain that which will benefit you and seek the help of Allaah, and do not feel helpless.” (Saheeh Muslim, hadeeth no. 2664)

Among those means are the following:

- Turning to Allaah by making du’aa’ in any way that is prescribed in Islam, such as saying, “Rabbiy ishrah li sadri wa yassir li amri (O my Lord, expand my chest and make things easy for me).”
- Getting used to sleeping early and going to exams on time.
- Preparing all required or permitted equipment such as pens, rulers and setsquares, calculators and watches, because being well prepared helps one to answer questions.
- Reciting the du’aa’ for leaving the house: “Bismillaah, tawakkaltu ‘ala Allaah, wa laa hawla wa laa quwwata illa Billaah. Allaahumma inni a’oodhu bika an adilla aw udalla, aw azilla aw uzalla, aw azlima aw uzlama, aw ajhala aw yujhala ‘alayya (In the name of Allaah, I put my trust in Allaah, and there is no strength and no power except with Allaah. O Allaah, I seek refuge with You lest I should stray or be led astray, lest I slip (commit a sin unintentionally) or be tripped, lest I oppress or be oppressed, lest I behave foolishly or be treated foolishly).” Do not forget to seek your parents’ approval, for their du’aa’ for you will be answered.
- Mention the name of Allaah before you start, for mentioning the name of Allaah is prescribed when beginning any permissible action; this brings blessing, and seeking the help of Allaah is one of the means of strength.
- Fear Allaah with regard to your classmates, and do not be affected by their anxiety or fear just before the exam, for anxiety is a contagious disease. Instead, make them feel optimistic by saying good words as prescribed in Islam. The Prophet (peace and blessings of Allaah be upon him) was optimistic when he heard the name of Suhayl (which means “easy”) and he said: “Things have been made easy for you.” He used to like to hear the words ‘Yaa Raashid, when he went out for any purpose. So be optimistic that you and your brothers will pass this exam.
- Remembering Allaah (dhikr) dispels anxiety and tension. If something is too difficult for you, then pray to Allaah to make it easy for you. Whenever Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) found something too difficult to understand, he would say, “O You Who taught Ibraaheem, teach me; O You Who caused Sulaymaan to understand, cause me to understand.”
- Choose a good place to sit during the exam, if you can. Keep your back straight, and sit on the chair in a healthy manner.
- Look over the exam first. Studies advise spending 10% of the exam time in reading the questions carefully, noting the important words and dividing one’s time between the questions.
- Plan to answer the easy questions first, then the difficult ones. Whilst reading the questions, write notes and ideas which you can use in your answers later.
- Answer questions according to importance.
- Start by answering the easy questions which you know. Then move on to the questions which carry high marks, and leave till the end the questions to which you do not know the answers, or which you think will take a long time to produce an answer or which do not carry such high marks.
- Take your time to answer, for the Prophet (peace and blessings of Allaah be upon him) said: “Deliberation is from Allaah and haste is from the Shaytaan.” (A hasan hadeeth. Saheeh al-Jaami, 3011).
- Think carefully about the answer and choose the right answer when answering multiple-choice questions. Deal with them in the following manner. If you are sure that you have chosen the right answer, then beware of waswasah (insinuating whispers from the Shaytaan). If you are not sure, then start by eliminating the wrong or unlikely answers, then choose the correct answer based on what you think is most likely to be correct. If you guessed at a correct answer then do not change it unless you are sure that it is wrong – especially if you will lose marks for a wrong answer. Research indicates that the correct answer is usually that which the student thinks of first.
- In written exams, collect your thoughts before you start to answer. Write an outline for your answer with some words which will indicate the ideas which you want to discuss. Then number the ideas in the sequence in which you want to present them.
- Write the main points of your answer at the beginning of the line, because this is what the examiner is looking for, and he may not see what he is looking for if it is in the middle of the page and he is in a hurry.
- Devote 10% of the time for reviewing your answers. Take your time in reviewing, especially in mathematical problems and writing numbers. Resist the desire to hand in the exam papers quickly, and do not let the fact that some people are leaving early bother you. They may be among the people who have handed in their papers too early.
- If you discover after the exam that you answered some questions incorrectly, then take that as a lesson in the importance of being well prepared in the future, and not rushing to answer questions. Accept the will and decree of Allaah and do not fall prey to frustration and despair. Remember the hadeeth of the Prophet (peace and blessings of Allaah be upon him), “If anything befalls you, do not say, ‘If only I had done such and such.’ Rather say, ‘Qadar Allaah wa maa sha’a kaan (the decree of Allaah and what He wills happened),’ for saying ‘if only’ opens the door for the Shaytaan.” (Saheeh Muslim, and the first part of this hadeeth was mentioned above).
- Note that cheating is haraam whether it is in foreign language tests or any other tests. The Prophet (peace and blessings of Allaah be upon him) said, “Whoever cheats is not one of us.” It is wrongdoing and it is a haraam means of attaining a degree or certificate, etc., that you have no right to. The consensus is that cheating is a kind of cooperation in sin and transgression. So do without that which is haraam, and Allaah will suffice you from His bounty. Reject all offers of haraam things that come to you from others. Whoever gives up a thing for the sake of Allaah, Allaah will compensate him with something better. You have to denounce and resist evil, and tell the authorities about any such thing that you see during the exam, or before or after it. This is not the forbidden kind of slander rather it is denouncing evil which is obligatory.
Advise those who buy or sell questions or post them on the Internet etc., or who prepare cheat notes. Tell them to fear Allaah, and tell them of the ruling on what they are doing and on the money they earn from that. Tell them that the time they are spending in preparing these haraam things, if they spent it in studying, or answering previous exams, or helping one another to understand the subject before the exam, that would be better for them than doing these haraam things.
- Remember what you have prepared for the Hereafter, and the questions of the examination in the grave, and how to be saved on the Day of Resurrection. Whoever is saved from the Fire and admitted to Paradise will indeed have succeeded.

We ask Allaah to make us succeed in this world and cause us to be among those who are victorious and saved in the Hereafter, for He is the All-Hearing Who answers prayer.

A woman kissed me and I responded to her, and we started touching

A woman kissed me and I responded to her, and we started touching one another and kissing, but when she asked me to have intercourse with her I refused for fear of the punishment of the zaani before Allaah. Am I an adulterer because of that? I only put my fingers in .

Praise be to Allaah.

Firstly:

What you did by kissing and touching this woman is a reprehensible haraam action from which you have to repent by regretting having done it and resolving not to go back to it. You also have to keep away from the things that lead to fitnah, such as mixing, being alone with a woman, and haraam looks. You should praise Allaah for having saved you from falling into the major sin of zina for which Allaah has issued a stern warning of punishment in this world and in the Hereafter, which includes the hadd punishment of stoning the zaani to death if he was married and giving him one hundred lashes if he is not married.

The Messenger (peace and blessings of Allaah be upon him) told us that zina is one of the reasons for which people will be punished in their graves, and he has told us of the horrific nature of this punishment. See the answer to question no. 8829.

How audacious this woman was when she transgressed the sacred limits set by Allaah, called you to haraam, sought evil and indulged in sin without any fear or shame. How great is the blessing of Allaah to you, that you stopped at that point; there was some trace of faith left in your heart that prevented you from committing the greater evil.

Secondly:

Undoubtedly the zina for which a person is to be punished in the manner described above is penetration, where the private parts meet. As for the things that lead to zina, such as touching, kissing and putting the fingers into the vagina, although they are haraam and abhorrent, the one who does them may be punished for doing them, but he is not punished with the hadd punishment that is meted out to the zaani; rather he should be rebuked and disciplined. As for naming, sharee’ah calls these actions zina, as it says in the hadeeth narrated by al-Bukhaari (6243) and Muslim (2657) from Abu Hurayrah (may Allaah be pleased with him) from the Prophet (peace and blessings of Allaah be upon him) who said: “Allaah has decreed for the son of Adam his share of zina which will inevitably catch up with him. The zina of the eye is looking and the zina of the tongue is speaking. The heart wishes and longs and the private part confirms that or denies it.”

According to the version narrated by Muslim: “The zina of the eyes is looking, the zina of the ears is listening, the zina of the tongue is speaking, the zina of the hand is touching, and the zina of the foot is walking. The heart wishes and longs and the private part confirms that or denies it.”

Ibn Battaal (may Allaah have mercy on him) said: Looking and speaking are called zina because they invite one to true zina. Hence he said: “the private part confirms that or denies it.” End quote from Fath al-Baari.

So hasten to repent to Allaah and cut off all ties with this woman who may cause you to lose your faith and chastity and make you one of the immoral evildoers. We ask Allaah to keep you safe and sound. Beware of the tricks of the Shaytaan, for the matter starts with a look and may end in evil deeds; may Allaah protect us and you.

Praise be to Allaah.

Firstly:

We ask Allaah to relieve your distress and make things easy for you, and to help you to obey Him and worship Him properly. Remember that the alienation that you are feeling is a good sign for you, The Prophet (peace and blessings of Allaah be upon him) said: “Islam began as something strange and will revert to being something strange, so glad tidings to the strangers.” Narrated by Muslim (145).

The word tooba (translated here as “glad tidings”) has many meanings, such as goodness and honour, a great tree in Paradise, joy and happiness, and many other meanings, all of which may apply here.

Al-Sindi (may Allaah have mercy on him) said:

“Strange” means because its followers are small in numbers. The basic meaning of ghareeb (stranger) is one who is far from his home.

“And will revert to being something strange” means that few will adhere to it and help others to do so, even if the Muslims are many.

“to the strangers” means those who follow its commands.

“Tooba” is derived from the word tayyib (good), and it is interpreted as referring to Paradise or to a great tree that grows there.

This indicates that supporting Islam and obeying its commands may require the one who does that to leave his homeland and be patient in bearing the hardships of being away from his homeland, as was the case when it first began.

Sharh Sunan Ibn Majaah (hadeeth no 3986.

Secondly:

You have the best example in the Messenger of Allaah (peace and blessings of Allaah be upon him). He brought light to his people, but they insisted on remaining in the darkness of kufr and ignorance. They accused him of being a sorcerer, soothsayer or madman, but he was patient in calling them, and he did not get fed up of repeating his call, using different methods of calling individuals and groups, calling in secret and in the open, until he attained great success. Similarly, daa’iyahs who came after him called the kuffaar to Islam, and called sinners to obedience, and called innovators to the Sunnah. Many of them experienced hardship, distress and difficulties, but that did not stop them from persisting in da’wah. Were it not for that, Islam would not have reached your country, the Maldives!

Think about these examples, and do what they did, and be patient as they were patient, so that you may attain the pleasure of Allaah. What you hear of mockery and being called “Wahhabis” was said by those who came before them, and the fools still repeat it with regard to those who promote the Sunnah, but that does not harm them or make them stop conveying the religion of Allaah.

Thirdly:

In addition to being patient in calling people, we advise you to select wise people among other women and your relatives to convey the religion of Allaah to them and remind them of the truths of Islam, for if people are happy to belong to Islam, that does not prevent them from following the Sunnah, but there may be other obstacles that are preventing them from coming to the path of truth, such as misguided scholars and proponents of bid’ah, or specious arguments and whims and desires, and so on. It may also be due to the fact that we are failing to convey the truth of Islam to them, or we do not have wise ways of conveying it.

You have to be gentle and patient, and select the wisest people, and address them politely. Use different means such as audio tapes, video lectures and books, and you may see some good results.

Fourthly:

Strive to make your house the focal point of this da’wah. Start with your husband and children, so that this will become a house of blessing for all people. Remember that our mother Khadeejah bint Khuwaylid was the first one of this ummah to become Muslim, and she was the first one to support the Prophet (peace and blessings of Allaah be upon him) in conveying the message and calling her daughters to Islam. Her house was the first house to become Muslim, and from it the call of goodness spread to all corners of the earth, so be like her and follow her example.

Can a Muslim be a sincere friend to a kaafir?

I have questions about Islam; can you explain them to me? Is it permissible for a Muslim to be a sincere friend to a person who is not Muslim?.

Praise be to Allaah.

It is not permissible for a Muslim to make friends with a mushrik or to take him as a close friend, because Islam calls on us to forsake the kaafirs and to disavow them, because they worship someone other than Allaah. Allaah says (interpretation of the meaning):

“O you who believe! Take not as friends the people who incurred the Wrath of Allaah (i.e. the Jews). Surely, they have despaired of (receiving any good in) the Hereafter, just as the disbelievers have despaired of those (buried) in graves (that they will not be resurrected on the Day of Resurrection)”

[al-Mumtahanah 60:13]

This was also the teaching of the Prophet (peace and blessings of Allaah be upon him).

1 – It was narrated from Abu Sa’eed al-Khudri (may Allaah be pleased with him) that he heard the Messenger of Allaah (peace and blessings of Allaah be upon him) say, “Do not keep company with anyone but a believer and do not let anyone eat your food but one who is pious.” (Narrated by al-Tirmidhi, 2395; Abu Dawood, 4832. Abu ‘Eesa al-Tirmidhi said: this hadeeth is hasan. It was also classed as hasan by al-Albaani in Saheeh al-Tirmidhi, 2519).

Abu ‘Eesa al-Khattaabi said: Rather he warned against keeping company with anyone who is not pious and against mixing with them or eating with them, because eating with a person instills friendship and love in the heart.

He said: do not make friends with anyone who is not pious; do not take him as a companion with whom you eat and chat.

(Ma’aalim al-Sunan, Haamish Mukhtasar Sunan Abi Dawood, 7/185, 186).

2 – It was narrated from Samurah that the Prophet (peace and blessings of Allaah be upon him) said: “Do not live among the mushrikeen and do not mix with them, for whoever lives among them or mixes with them is not one of us.” (Narrated by al-Bayhaqi, 9/142; al-Haakim, 2/154. He said, it is saheeh according to the conditions of al-Bukhaari. The hadeeth was also classed as saheeh by al-Albaani in al-Silsilat al-Saheehah, 2/229 with its corroborating reports).

But it is permissible to deal with them in a kind manner in the hope that they might become Muslim.

It was narrated that Anas (may Allaah be pleased with him) said: There was a Jewish boy who used to serve the Prophet (peace and blessings of Allaah be upon him), and he fell sick. The Prophet (peace and blessings of Allaah be upon him) came to visit him. He sat by his head and said, “Become Muslim.” (The boy) looked at his father who was with him, and he (the father) said, “Obey Abu’l-Qaasim (peace and blessings of Allaah be upon him).” So he became Muslim, and the Prophet (peace and blessings of Allaah be upon him) went out, saying, “Praise be to Allaah Who has saved him from the Fire” (Narrated by al-Bukhaari, 1290).

The Arabic word ightisaab refers to taking something wrongfully by force. It is now used exclusively to refer to transgression against the honour of women by force (rape).

This is an abhorrent crime that is forbidden in all religions and in the minds of all wise people and those who are possessed of sound human nature. All earthly systems and laws regard this action as abhorrent and impose the strictest penalties on it, except a few states which waive the punishment if the rapist marries his victim! This is indicative of a distorted mind let alone a lack of religious commitment on the part of those who challenge Allaah in making laws. We do not know of any love or compassion that could exist between the aggressor and his victim, especially since the pain of rape cannot be erased with the passage of time – as it is said. Hence many victims of rape have attempted to commit suicide and many of them have succeeded, The failure of these marriages is proven and they are accompanied by nothing but humiliation and suffering for the woman.

Islam has a clear stance which states that this repugnant action is haraam and imposes a deterrent punishment on the one who commits it.

Islam closes the door to the criminal who wants to commit this crime. Western studies have shown that most rapists are already criminals who commit their crimes under the influence of alcohol and drugs, and they take advantage of the fact that their victims are walking alone in isolated places, or staying in the house alone. These studies also show that what the criminals watch on the media and the semi-naked styles of dress in which women go out, also lead to the commission of this reprehensible crime.

The laws of Islam came to protect women's honour and modesty. Islam forbids women to wear clothes that are not modest and to travel without a mahram; it forbids a woman to shake hands with a non-mahram man. Islam encourages young men and women to marry early, and many other rulings which close the door to rape. Hence it comes as no surprise when we hear or read that most of these crimes occur in permissive societies which are looked up to by some Muslims as examples of civilization and refinement! In America – for example – International Amnesty stated in a 2004 report entitled “Stop Violence Against Women” that every 90 seconds a woman was raped during that year. What kind of life are these people living? What refinement and civilization do they want the Muslim women to take part in?

The punishment for rape in Islam is same as the punishment for zina, which is stoning if the perpetrator is married, and one hundred lashes and banishment for one year if he is not married.

Some scholars also say that he is required to pay a mahr to the woman.

Imam Maalik (may Allaah have mercy on him) said:

In our view the man who rapes a woman, whether she is a virgin or not, if she is a free woman he must pay a “dowry” like that of her peers, and if she is a slave he must pay whatever has been detracted from her value. The punishment is to be carried out on the rapist and there is no punishment for the woman who has been raped, whatever the case. End quote.

Al-Muwatta’, 2/734

Shaykh Salmaan al-Baaji (may Allaah have mercy on him) said:

In the case of a woman who is forced (raped): if she is a free woman, the one who forced her must pay her a “dowry” like that of her peers, and the hadd punishment is to be carried out on him. This is the view of al-Shaafa’i, and it is the view of al-Layth, and it was also narrated from ‘Ali ibn Abi Taalib (may Allaah be pleased with him).

Abu Haneefah and al-Thawri said: the hadd punishment is to be carried out on him but he is not obliged to pay the “dowry”.

The evidence for what we say is that the hadd punishment and the “dowry” are two rights, one of which is the right of Allaah and the other is the right of the other person. So they may be combined, as in the case of a thief whose hand is cut off and he is required to return the stolen goods. End quote.

Al-Muntaha Sharh al-Muwatta’, 5/268, 269

Ibn ‘Abd al-Barr (may Allaah have mercy on him) said:

The scholars are unanimously agreed that the rapist is to be subjected to the hadd punishment if there is clear evidence against him that he deserves the hadd punishment, or if he admits to that. Otherwise, he is to be punished (i.e., if there is no proof that the hadd punishment for zina may be carried out against him because he does not confess, and there are not four witnesses, then the judge may punish him and stipulate a punishment that will deter him and others like him). There is no punishment for the woman if it is true that he forced her and overpowered her, which may be proven by her screaming and shouting for help. End quote.

Al-Istidhkaar, 7/146

Secondly:

The rapist is subject to the hadd punishment for zina, even if the rape was not carried out at knife-point or gun-point. If the use of a weapon was threatened, then he is a muhaarib, and is to be subjected to the hadd punishment described in the verse in which Allaah says (interpretation of the meaning):

“The recompense of those who wage war against Allaah and His Messenger and do mischief in the land is only that they shall be killed or crucified or their hands and their feet be cut off from opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter”

[al-Maaidah 5:33]

So the judge has the choice of the four punishments mentioned in this verse, and may choose whichever he thinks is most suitable to attain the objective, which is to spread peace and security in society, and ward off evildoers and aggressors.
